Avec la reprise de l’activité, les mesures de prise de température des salariés à l’entrée des entreprises se sont rapidement généralisés.


Cependant, aucun règlement ni aucune loi n’exige la prise de température quotidienne de tous les individus à l’entrée d’une entreprise. Cela ne correspond non plus aux recommandations du gouvernement. En effet, cette mesure n’atteint que partiellement l’objectif visé, puisque la température n’est pas systématiquement observée pour le Covid-19. Une prise de température peut témoigner d’une toute autre infection. Il s’agit d’une mesure préventive qui vise à écarter du milieu de travail des salariés qui auraient de la fièvre, dans la crainte d’une contamination.

Un article du code du travail autorise une application immédiate des obligations relatives à la santé et à la sécurité avec communication simultanée au secrétaire du comité social et économique, ainsi qu’à l’inspection du travail.

Ces mesures de prise de température doivent alors respecter les dispositions du code du travail.
Ces mesures doivent :

  • être conforme et proportionnées vis à vis du règlement intérieur,
  • répondre à une information préalable,
  • respecter les principes de conservation des données,
  • le geste de prise de température doit préserver la dignité.
